Any advice on how to get the 7% back. Do I have to file a california tax return and which parts do I have to fill out. I live overseas and have no other US source income.

What I don't understand is why this tax is being levied only on out-of-state landlords. I had to leave my home in California and find another job in another state after being laid off. So now after being forced to move out of state for work, I am further penalized with a 7% tax when I try to rent out my property. The rent, by the way, doesn't even come close to my mortgage payments, so I am losing money monthly. On top of that why is CA taxing 7% of gross, not net after expenses such as my property management fees.

This just doesn't make sense to me. I'm between a hard place and a rock. And I can't sell my house because the devaluation of CA property over the last couple years. No matter which way I turn, I am hosed!

There are already companies sending out letters to out of state property owners asking them if they want to sell their rental property because of this new policy. I've seen them. I also have a rental and had no idea about this until I saw a client's letter.

Putting the burden on property management companies will definitely drive their clientèle down. This does not seem like it will be helpful to the FTB because if out-of-state clientele decline, so will their tax dollars-lose lose situation.
